1. ABOUT THESE TERMS OF SERVICE

 

1.1. Application of Terms

These Terms of Service (the "Terms of Sale") apply when you use our websites (at https://wearthirsty.com or https://thirstylaboratory.com) (the "Websites") to purchase goods (the "Products"). By purchasing any Products, you confirm that you agree to these Terms of Sale. These terms should be read alongside any specific terms applicable to the Products.

 

2. ORDERS ARE NOT ACCEPTED UNTIL CONFIRMED

 

Once we have accepted your order, we will send you an email to confirm it. Please note that your order is NOT confirmed until you receive this email acceptance.

 

3. PRICES ARE SET AT OUR DISCRETION

 

We set the price for Products at our sole discretion. Prices can be changed by us at any point before the checkout is completed. Always check the relevant order page for the final payable price before completing the checkout process.

3.1 PLEASE NOTE THAT FOR INTERNATIONAL ORDERS (INCLUDING SHIPMENTS TO THE U.S.), PRICES DO NOT INCLUDE IMPORT DUTIES, CUSTOMS FEES, OR LOCAL TAXES. AS THE RECIPIENT, YOU ARE THE IMPORTER OF RECORD AND ARE RESPONSIBLE FOR PAYING THESE CHARGES TO THE CARRIER (E.G., DHL) UPON DELIVERY. FAILURE TO PAY THESE DUTIES MAY RESULT IN THE PRODUCT BEING RETURNED TO US, SUBJECT TO THE TERMS IN SECTION 11.

 

4. WE CAN REJECT ORDERS

 

We may need to reject an order, even after it has been confirmed. Reasons for rejection include:

  • • A Product unexpectedly becoming out of stock.
  • • We can’t verify your age (for age-restricted Products).
  • • Your delivery address is outside our delivery areas.
  • • The price of the Product was mistakenly stated by us.

When this happens, we will notify you and refund any sums you have paid.

 

5. PAYMENT AND OWNERSHIP

 

We will take payment for all orders at the point you complete the checkout process. You will own your ordered goods once we have received payment in full.

 

6. WE'RE NOT RESPONSIBLE FOR DELAYS OUTSIDE OUR CONTROL

 

If supply or sale is delayed by an event outside our control (e.g., natural disasters, war, a pandemic), we will contact you as soon as possible about the delay. We will do what we can to reduce the delay, and as long as we do this, we won't compensate you for the delay.

If the delay is likely to be substantial (a day or more), contact our Customer Service Team at CONTACT@WEARTHIRSTY.COM to discuss options.

 

7. PRODUCTS CAN VARY SLIGHTLY FROM THEIR PICTURES AND DESCRIPTIONS

 

While we try to ensure accurate images, a Product (or its packaging) may slightly differ from how it is displayed on your device.

 

8. YOUR RIGHT TO CHANGE YOUR MIND (LIMITED)

 

8.1. General Right to Refund

For most Products, you have a legal right to change your mind and receive a refund, including standard delivery costs. This is subject to the conditions below.

8.2. You CAN'T Change Your Mind About an Order for:

  • • Products sealed for health protection or hygiene once they have been unsealed.
  • • Goods that are made to your specifications or are clearly personalised.
  • • Goods which become mixed inseparably with other items after their delivery.

8.3. Time Limit

You must notify us you want to change your mind no later than 14 days after the day we deliver your Product (or the last delivery, if split).

9. YOU HAVE TO RETURN THE PRODUCT AT YOUR OWN COST

 

You must return any Products (and any free gifts) to us within 21 days of telling us you've changed your mind.

Returns are at your own cost, unless we offered free returns when you bought the goods. You should keep a receipt as proof you sent it. If we don't receive the goods at all, or within a reasonable time (21 days), we won't refund you.

 

10. DELIVERY TIMEFRAMES ARE ESTIMATES

 

We provide an estimate of delivery timescales and will make every effort to meet them. However, delays are sometimes inevitable due to unforeseen factors (e.g., material shortages, high demand). We are not liable for any failure to deliver within the estimated timescales as a result of such delays.

11. REFUSED DELIVERIES

 

If a delivery is refused by you and returned to us, you are responsible for the return shipping costs. These costs will be deducted from any refund. Re-attempted deliveries will be processed as a new order, and you are responsible for the shipping cost.

 

12. WE ONLY REFUND STANDARD DELIVERY COSTS

 

We don't refund any extra amount you paid if you chose a premium delivery option (e.g., express delivery).

 

13. WE REDUCE YOUR REFUND IF YOU HAVE USED OR DAMAGED A PRODUCT

 

If you handle the Product in a way that wouldn't be acceptable in a store, we will reduce your refund to compensate us for its reduced value.

For example, we reduce your refund if:

  • • The Product’s condition is not “as new”.
  • Price tags have been removed or packaging is damaged.
  • Accessories are missing.

In some cases, no refund may be due. Our Customer Service Team at CONTACT@WEARTHIRSTY.COM can advise you.

 

14. WHEN AND HOW WE REFUND YOU

 

14.1. Product Not Yet Processed for Delivery

We will refund you within 14 days of you telling us you've changed your mind.

14.2. Product Delivered and Returned

We will refund you within 21 days of receiving the goods back from you (or receiving evidence you've sent them to us).

14.3. Method

We refund you by the method and in the currency you used for payment. We don't charge a fee for the refund.

 

15. YOU HAVE RIGHTS IF THERE IS SOMETHING WRONG WITH YOUR PRODUCT

 

If you think there is something wrong with your Product, you should ONLY contact us via our Customer Service Team at CONTACT@WEARTHIRSTY.COM.

 

16. WE CAN CHANGE PRODUCTS

 

We can always change a Product to:

  • • Reflect changes in relevant laws and regulatory requirements.
  • • Update the price payable for any future purchases.
  • • Make minor technical adjustments and improvements (e.g., to address a quality defect) that won't impact the overall use.

 

17. WE CAN WITHDRAW ANY OF THE PRODUCTS

 

We will aim to let you know in advance if this happens and will aim to refund any sums you've paid in advance for Products which won't be provided.

 

18. WE CAN END OUR CONTRACT WITH YOU

 

We can end our contract with you and claim any compensation due to us if:

  • • You don't make any payment when due, and you still don't make payment within 7 days of our reminder.
  • • You don't provide us with information or cooperation we need to provide the Product within a reasonable time.
  • • You don't, within a reasonable time, allow us to deliver the Product to you or collect it from us.
  • • You breach any applicable third-party terms.

 

19. PROHIBITION ON COMMERCIAL RESALE

 

OUR PRODUCTS ARE SOLD FOR PERSONAL, NON-COMMERCIAL USE ONLY. By purchasing, you agree not to buy, use, market, or distribute our Products for commercial resale without our prior written consent. We reserve the right to refuse, limit, or cancel any order intended for commercial resale. Unauthorized resale may face legal action.

 

20. WE DON'T COMPENSATE YOU FOR ALL LOSSES CAUSED BY US OR OUR PRODUCTS

 

We are responsible for losses you suffer caused by us breaking these Terms of Sale unless the loss is:

  • Unexpected (Unforeseeable): It was not obvious that it would happen.
  • Caused by a Delaying Event Outside Our Control: As long as we took the steps set out in Section 6.
  • Avoidable: Something you could have avoided by taking reasonable action (e.g., following care instructions).
  • A Business Loss: Relates to your use or purchase of a Product for your trade, business, craft, or profession.

 

21. WE KEEP YOUR PERSONAL DATA SAFE

 

Your data is kept safe and used for marketing purposes by the Websites.

 

22. YOU HAVE AN OPTION FOR RESOLVING DISPUTES WITH US

 

If you have an issue, we would appreciate it if you contacted us first and allowed our team to resolve any problems you have with us or our Products.

 

23. OTHER IMPORTANT TERMS APPLY TO OUR CONTRACT

 

  • Transfer of Contract by Us: We can transfer our contract to a different organization. We'll tell you in writing if this happens, and it won't affect your rights.
  • Transfer by You: You can only transfer your contract with us to someone else if we agree to this.
  • Contract Enforcement: These Terms of Sale are a contract between you and us. Nobody else can enforce it.
  • Delay in Enforcement: Even if we delay in enforcing these terms, we can still enforce them later.
